These Terms & Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Scottish Law.

We may revise our Terms & Conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these Terms & Conditions may also be superseded by provisions or notices published elsewhere on our website.

Age Restriction

We can only sell alcohol products to those aged 18 and over. In the UK it is illegal for any person under the age of 18 to buy, or attempt to buy, alcohol for themselves or for any other person under the age of 18. By placing an order, you confirm that you are at least 18 years of age.

Payments

We accept payment online by Debit Card, Visa, Mastercard, Delta, American Express, Apple Pay and Google Pay. Please e-mail [email protected] for further details.

Website Security

Although we will do our best to protect your personal data, please recognise we cannot guarantee the complete security of your data transmitted to us electronically, any transmission is at your own risk.

All payment transactions on our website are performed using a secure server with 128-bit SSL encryption. Transactions are made on our behalf by PayPal and Stripe.

We do not store any financial information i.e., credit/debit card details on our website.

Identity Verification

To ensure that your credit, or debit card is not being used without your consent and you are over the age of 18, we will validate name, address and other personal information supplied by you during the order process against appropriate third-party databases. By accepting these Terms & Conditions, you consent to such checks being made.

In performing these checks, personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 2018.

Online Shop Prices

All prices are shown in GBP (British Pound) at point of sale (not at the point of despatch). All prices quoted include VAT at the current rate of 20%. [To see prices without VAT, if you are outside of the United Kingdom, you need to enter your address in the Checkout]. Prices shown for products on our website are not inclusive of delivery charge.

All goods remain the property of Dunnet Bay Distillers Ltd until they are paid for in full. Prices and manufacturers’ specifications are subject to change at any time, without notice. Pricing on our website and onsite shop may differ. Orders taken over the telephone will be charged at onsite shop prices.

Online Shop Availability

All products offered for sale are subject to availability and we cannot guarantee availability of the products listed on our website. If we are unable to fulfil your order due to the non-availability of certain item(s), we will contact you within 3 working days of receiving your order to arrange alternatives or a refund where applicable.

Acceptance

As all products and services on our website are subject to availability, there will be no contract of any kind between you and us until we process and despatch your order. At any point up until then, we may decline to fulfil your order without giving any reason.

Payment

We use PayPal or Stripe to accept payments allowing you to use your bank account, credit/debit card or your PayPal balance to pay for an online order.

Your payment details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be automatically charged for your order once your payment details have been accepted.

The total cost of your order is the price of the item(s) ordered plus delivery. You will be asked to confirm that the credit or debit card that is being used is your own. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

We reserve the right to withdraw any products from our website at any time and/or remove or edit any material or content on this site. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our discretion. We will not be liable to you or any third-party by reason of our withdrawing any product from this website whether or not that product has been sold.

The price you pay is the price displayed on our website at the time we receive your order, and will be clearly stated on your order confirmation, with the following exception. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled, and will give you a full refund.

For orders outside the United Kingdom many credit/debit card issuers now charge a conversion fee for transactions in currencies other than the currency assigned to your card.

Order Confirmation

We will obtain authorisation on your card before your order is accepted. Once authorised we will send an “Order Confirmation” to the e-mail address you have supplied to us. You will be notified if there are any delays. If there are any problems with your order or if your item(s) is out of stock, you will be contacted by one of our customer services representatives either by e-mail or by telephone. We reserve the right to cancel your order if there is reason to until the point of dispatch. If this occurs, we will notify you and refund your order in full.

Delivery

These Terms & Conditions will apply to all transactions on our website. You should read through them carefully before placing your order.

When you place an order, we will require your name, and e-mail address. Without this information we will not be able to process your request or notify you of acceptance of your order.

A contact telephone number is also required so that we may reach you if there is a problem with your order, or if your order requires a delivery quote. We may, unless you advise us otherwise, pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order. As part of our efforts to ensure that you are aware of the latest developments and offers, we may also use this information to advise you of new products, special offers or changes to our site. Most orders are dispatched within 48 hours of an order being placed. We only dispatch and deliver Monday – Friday.

Delivery: UK Orders

Orders over £50.00 include free delivery, please select the box for “FREE DELIVERY” at the check-out so you don’t get charged for delivery.

All UK orders are sent by courier. We can deliver to your home or work address. We cannot accept any liability if the address is entered onto our website incorrectly or is incomplete. Deliveries to work addresses shall be deemed successful if a representative at that address accepts and signs for the goods.

We will always do our best to fulfil your order as quickly as possible. If your order is time specific i.e., for a special occasion please contact [email protected] prior to ordering. We might experience delays due to high order numbers particularly around Christmas, however we will endeavour to let you know if there is any delay in delivering your order. If your order fails to arrive after 28 days from the date of your order, please contact [email protected]

We do our best to secure delivery within 28 days of the date of your order, however we will not be liable for any loss occasioned by delay in delivery arising from any cause beyond our control. UK orders will normally be delivered within 3 days of despatch.

If the order is returned to us by the courier or otherwise due to non-delivery, Dunnet Bay Distillers Ltd will give you the option of resending your order at the purchaser’s expense or refunding the purchase less the cost of postage and packing.

We cannot deliver to PO boxes.

[Delivery: International Orders]

[We only include VAT for UK orders. Orders placed from outside of the UK, are subject to taxes and duty on arrival at the destination country. The delivery price quoted on our website does not include these charges. Dunnet Bay Distillers Ltd does not control import duty charges nor are we liable to pay any of these charges. Please check if these apply before ordering.

Orders for European destinations usually takes 5–10 days to arrive. Orders for other worldwide destinations can take 5–20 working days to arrive. There may be additional charges for delivery to some remote areas/regions in some countries. These timeframes are those recommended by Royal Mail and other courier companies that we use and based on normal weather and operational conditions. In exceptional and unforeseen circumstances there could be delays that result in an order arriving after the predicted delivery date.

Dunnet Bay Distillers Ltd do not accept liability for failed or delayed deliveries resulting from inaccurate information supplied within orders].

Returns & Refunds

We hope you will be happy with your purchase. When you receive your order, please check it carefully and notify us, within 2 days, if you have the wrong item(s), or if any part of your order has been damaged or is missing. Dunnet Bay Distillers Ltd is not liable for the loss or damage during transit of your order.

You may cancel your order by informing Dunnet Bay Distillers Ltd within 7 days of receiving confirmation of your order. Please return it to us unopened, sealed and in its original condition and within 7 days of the date of cancellation, for a refund. You are responsible for paying for your order to be shipped back to us, and we are unable to refund your postal fees. Please ensure that the returned items are boxed and securely packaged for the journey back to us. Failure to do so may result in damage to the item which we will not be held responsible for. Dunnet Bay Distillers Ltd will refund the cost of your purchase within 30 days of you notifying us about its return, to the credit/debit card or PayPal account used to make the original purchase.

Any item that has been personalised is non-returnable and non-refundable. 

We are not able to refund any import duties, taxes or administration fees incurred in connection with the delivery or return of an order.

Gift Vouchers

Gift vouchers are non-refundable and can be redeemed here at www.stannergill.co.uk or in our temporary distillery shop. The voucher code is valid until fully redeemed within the expiry date, 2 years from the date of purchase.

If you do not use the balance of your gift voucher all at a time, you can use your voucher code for future transactions.

The gift voucher recipient must be aged 18 years or over. Gift vouchers cannot be issued to children.

Tour Bookings Terms & Conditions

All persons taking a tour of Castletown Mill must purchase a ticket. Tickets must be retained at all times and submitted for inspection if required.

Any tickets purchased in advance are not valid in conjunction with any other voucher, promotion, special offer or package.

No ticket may be resold. If Dunnet Bay Distillers Ltd reasonably believes that a tour ticket has been resold, the holder may be refused entry to the tour without payment of compensation.

Ticket prices may be subject to change. However, all pre-booked tickets will be honoured at the rate applied at the time of purchase.

A child is aged between 0 and 17 years inclusive. An adult is aged 18 years and over. Children aged 17 and under can participate on a guided Family Distillery Tour free of charge. Tour visitors under the age of 18 must be accompanied by a paying adult, always aged 18 years or over. One paying adult may supervise up to a maximum of 2 children/under 18’s in the tour area.

Tour ticket holders should arrive at the Castletown Mill reception desk at least 10 minutes prior to the time printed on your ticket. Your booking reference must be produced as proof of booking on the day of the visit. Payments for tour bookings are non-refundable and tickets may only be changed or replaced at the discretion of Dunnet Bay Distillers Ltd. Should you miss your allocated time another tour slot cannot be guaranteed. Tour bookings are non-transferable and as a licensed premises Dunnet Bay Distillers Ltd retains the right at its discretion to refuse entry to Castletown Mill.

Dunnet Bay Distillers Ltd will endeavour to ensure that its guided distillery tours and experiences are open for use by visitors. However, we reserve the right, for safety, maintenance, or other valid reasons to close any part of Castletown Mill with or without prior notice. In the event of such closure Dunnet Bay Distillers Ltd will issue visitors with a full refund for their tour ticket, but otherwise shall have no liability whatever, including no liability for travel or out of pocket expenses in respect of closure of part of the venue or cancellation of a guided tour.

Other than liability for death or personal injury resulting from Dunnet Bay Distillers negligence, its employees or agents shall not be liable for any loss or damage, direct or indirect, howsoever arising, including without limitation any distress, inconvenience or anxiety caused during any visit undertaken and/or during evacuation from Castletown Mill.

Photography is permitted in the exhibition and tour areas unless otherwise stated. To prevent fire risk flash photography is strictly prohibited within the Still House and other working areas of the distillery.

From time-to-time Dunnet Bay Distillers Ltd or other authorised parties may carry out photography and/or video recording and/or other monitoring which may feature visitors. By accepting these Terms & Conditions, you agree that Dunnet Bay Distillers Ltd or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Dunnet Bay Distillers Ltd or such authorised party (as the case may be).

To prevent offensive weapons or dangerous articles from being taken into Castletown Mill, all visitors are admitted to the exhibition and tour areas within Castletown Mill subject to a condition that, if requested to do so, they will allow themselves and/or their belongings to be searched.

In accordance with Scottish Law and to prevent fire risk smoking is strictly prohibited within Castletown Mill.

Dogs and other pets are prohibited inside the exhibition, tour areas, Still House and other working areas of the distillery apart from Guide Dogs and other Assistance Dogs. Well-behaved and supervised pets are allowed in The Grain Store Distillery Shop and Calder’s Cottage: The Mill House Bistro on the bistro terrace area.

These Terms & Conditions are governed by and shall be construed in accordance with Scottish Law, any claim brought against these Terms & Conditions shall be subject to the exclusive jurisdiction of Scottish Law.
